These Terms and Conditions (“Terms”) govern your use of EZTest.ai, an AI-powered developer tool that helps write unit tests for your code through integration with many third party tools, offered in both an open-source version and a paid cloud-based version (“Service”). Please read these Terms carefully before using the Service.

By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Definitions

  • “EZTest.ai”, “we”, “us”, or “our”: Refers to the EZTest.ai platform, including its open-source and paid cloud versions.

  • “User” or “you”: Refers to any individual or entity who uses or accesses the Service.

  • “Third Party Integration”: Refers to the ability of the Service to interact with platforms such as GitHub, GitLab, OpenAI and many more for the purpose of generating unit tests.

 

2. Service Description

EZTest.ai is an AI-powered tool that assists developers by generating unit tests for their codebase through integration with GitHub. It offers:

  • An open-source version that can be freely used, modified, and distributed in accordance with the terms of its respective open-source license.

  • A paid cloud version that provides additional features such as enhanced performance, cloud-based storage, collaboration tools, and advanced integrations.

 

3. User Responsibilities

  • Eligibility: By using the Service, you confirm that you are at least 18 years old, or you are using the Service with the consent of a parent or guardian if under 18.

  • Compliance: You agree to use the Service only in compliance with applicable laws, including but not limited to laws regarding intellectual property, data privacy, and online conduct.

  • Account Security: If you use the cloud version of the Service, you are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use of your account.

 

4. Third Party Integration

By using the integration feature, you allow EZTest.ai to access your repository for the sole purpose of generating unit tests. You retain all ownership and rights to the code in your repository. EZTest.ai does not claim ownership of any code you upload or integrate with any source control.

 

5. Open Source Version

  • The open-source version of EZTest.ai is governed by its respective open-source license, which can be found on the project’s GitHub repository. This version is free to use, modify, and distribute.

  • Contributions to the open-source project are welcomed but must be made in accordance with the contribution guidelines provided in the repository.

 

6. Paid Cloud Version

  • Subscription Plans: The paid cloud version is available through various subscription plans. Pricing details are outlined on our website and may change from time to time. All fees are payable in advance and are non-refundable unless stated otherwise.

  • Trial Period: EZTest.ai may offer a trial period for the paid cloud version. The terms of any trial period, including duration and features, will be clearly communicated prior to the start of the trial.

  • Payment: Payments for the paid cloud version are processed through a third-party payment processor. You agree to provide accurate and complete payment information and authorize EZTest.ai to charge the applicable fees for your subscription.

 

7. Privacy and Data Usage

EZTest.ai takes privacy seriously. Our Privacy Policy outlines how we collect, use, and protect your data. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

 

8. Intellectual Property

  • Ownership: EZTest.ai retains all intellectual property rights in the Service, including but not limited to the software, documentation, and branding.

  • License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.

  • User Content: You retain ownership of any code, files, and data you upload or integrate with any source control. However, by using the Service, you grant EZTest.ai a license to use, store, and process this content for the purpose of providing the Service to you.

 

9. Prohibited Activities You agree not to:

  • Use the Service for any illegal, harmful, or unauthorized purposes.

  • Interfere with the functioning of the Service, including by attempting to gain unauthorized access to systems or data.

  • Distribute malware, viruses, or any other malicious code through the Service.

  • Use the Service to violate the rights of others, including intellectual property rights or privacy rights.

 

10. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, for any reason, including violations of these Terms. Upon termination, you must cease using the Service and destroy any copies of the software or documentation in your possession.

 

11. Disclaimers and Limitation of Liability

  • As Is: The Service is provided “as is” without warranty of any kind, express or implied. We do not warrant that the Service will be error-free or uninterrupted.

  • Limitation of Liability: To the fullest extent permitted by law, EZTest.ai’s liability for any claim related to the Service will be limited to the amount you paid for the Service in the last 12 months, if applicable. We are not liable for any indirect, incidental, special, or consequential damages.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless EZTest.ai and its affiliates, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Service, your violation of these Terms, or any third-party claims related to your content.

 

13. Changes to These Terms

We may modify these Terms from time to time. Any changes will be posted on our website, and the revised Terms will take effect as soon as they are posted. Your continued use of the Service after any modifications constitutes your acceptance of the new Terms.

 

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Chennai, India, without regard to its conflict of law principles. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts located in Chennai, India.
